U.S. District Judge Phyllis Hamilton did not grant Apple an injunction against Amazon's App Store saying that while she did not think Apple's App Store trademark was generic, she disagreed that Apple had shown any potential for consumer confusion in respect to the two different app stores.  The trial is scheduled to begin in October.

The case in U.S. District Court, Northern District of California is Apple Inc v. Amazon.com Inc, 11-1327.
